GENERAL DATA PROTECTION REGULATIONS The General Data Protection Regulations, or ‘GDPR’ as more commonly known, come in to effect on 25 May 2018. In accordance with these regulations we outline here what personal data we collect from you, how that data is secured and how any records we retain in respect of yourself may be accessed by you. For the purposes of the regulations we are a ‘controller’ of data, and NOT a ‘processor’ of data (because we do not share your data with anyone other than as outlined below in connection with booking your tour). What records we keep If, and only if, you book a self-drive tour with us, we will make a record of your name, your address, your email address and phone number and, if we book a Channel crossing for you, the registration number of the vehicle you will be using (we do not need details of your vehicle if you are making your own arrangements). In the case of your name, address and vehicle registration number, these details are entered on to a single Microsoft Excel spreadsheet which is retained on just one single desktop computer which cannot be accessed by anyone other than the two directors of Somme Battlefield Tours Ltd (by way of a password). Neither   your   phone   number   or   email address   are   entered   on   to   our   to   computer   database (a written record on a hand-written paper file only). Incoming and outgoing emails are processed by British Telecom in accordance with their GDPR compliance procedures. Please also note that we do not use any form of ‘cloud’ storage or sharing. The personal details we keep are retained on just one computer, access to which is protected by the most up-to-date firewall, password and McAfee security. Do we share your details with anyone? The short answer is absolutely   not , other than with your permission passing your name (and phone number if you agree) to the hotel we book for you, as well as Eurotunnel or P&O Ferries if booking you a Channel crossing. Unlike some larger companies, we do NOT share your personal details with anyone for
whatever purpose, or for whatever reason. It’s as simple as that! If I pay by credit or debit card, will these details also be held on a computer? Absolutely not. When paying by debit or credit card we do not record any details on our computer or any other electronic recording device/database. The only record we do keep is a copy of the receipt produced by our card terminal, which is clipped to the paper record of your tour booking. A copy of the same receipt will be sent to you when we post your guide package. To ensure maximum security when paying by either debit or credit card, we do not offer this facility as an on-line feature on our website. All payments are therefore only taken by phone. What is your policy on sending unsolicited emails? Quite simple really. We will NEVER send emails to anyone unless they have emailed us first seeking further information about our tours. We will never engage in the practice of sending out unsolicited emails promotional emails, not just because the regulation prohibit this most annoying practice, but because we hate it ourselves! Can I have a copy of the record you retain on your database? Yes. Once we have verified that you are the person in question we will be pleased to provide you with a screen- shot of your data. We remain vigilant to guard against any attempt to obtain your details by way of fraudulent representation, hence the verification question we will need to ask you before any personal details are released. Does you website use cookies or any other form of tracking devices? Most certainly NOT! We built our website ourselves and so have complete control over its content. That’s why we know for sure that our website is 100% ‘clean’ with no hidden trickery lurking behind what you see. TERMS AND CONDITIONS Abbreviations and meanings For the purposes of these booking conditions terms such as ‘us’, ‘we’ and ‘our’ shall mean Somme Battlefield Tours Ltd (the tour ‘organiser’). ‘Tour’ refers to both Self-Drive and Conducted Tours unless otherwise stated. The term ‘you’ and ‘your’ refers to the person making the booking. ‘Party’ and ‘group’ means those persons travelling with you, on behalf of whom you are making the booking. Payment A deposit of £80 per person or 25% of the total tour cost, whichever is the greater, is payable on booking either a self-drive tour. Payments can be made either by credit or debit card (Visa or MasterCard). Cheques are no longer accepted. All credit card payments are paid direct to our Trust Account (see Security of Payments). All payments must be made in GB Pounds Sterling (credit card payments for those living outside the UK are usually converted automatically). Final balance If you do not pay in full when booking your tour, your outstanding balance is payable not less than 56 days prior to your date of departure. If the balance has not been paid by 48 days prior to departure, we have the option to cancel your booking and levy the cancellation charges set out below under ‘Cancellations’. Your Self-Drive guide pack comprising our written guides, directions, maps etc will be forwarded to you upon receipt of the final balance. Security of Payments We fully comply with the provisions of the Package Tours Regulations 2018. In accordance with these regulations, all payments made to Somme Battlefield Tours Ltd., either as deposit or final settlement (including all credit card payments), are held in a separate trust account (Barclays Bank plc, Wimborne, Dorset) and in accordance with the above regulations cannot be released to Somme Battlefield Tours Ltd. until the specified tour has taken place. This regulation guarantees a full refund of all monies paid in the most unlikely event of us failing to provide the tour booked. Deposit If we are more than 56 days away from the commencement of your tour, then a non-refundable deposit of £80 per person or 25% of the total tour cost, whichever is the greater, is required to secure a booking. The balance of your tour will be due to be paid 56 days ahead of your departure date, at which time all guide material, directions etc will be forwarded to you. If we are within the above 56-day period then payment in full will be required upon booking a tour, but subject to the below cancellation charges. Cancellations 1. If you have to cancel your tour or any component part of a tour Once a deposit has been paid your tour cannot be re-scheduled. However, at   our   discretion , we may endeavour to re-schedule your self-drive tour as outlined (3) below, subject to a higher deposit requirement, and on the basis that a re-scheduled tour cannot be again re-scheduled. If you have to cancel your tour, including any component part of a tour for all or part of your tour group, such as Channel crossing, hotel rooms, guide etc, for ANY reason (including you or any of your group having tested positive for Covid or a Covid mutation, and/or being unable to travel due to quarantine/self-isolation requirement, and/or intentional or unintentional non-compliance with prevailing travel vaccination documentation requirements), or a service provider booked by you direct as opposed to having been booked by us, such as hotel accommodation, ferry company or Eurotunnel, failing for whatever reason to provide the service, then the following scale of cancellation charges, that is the money you will forfeit should you cancel a tour, shall apply to all tours (clear days notification relative to date of departure). Cancellations must be notified in writing by either post or email, and the below scales shall be based on the date such notification is received. More than 56 clear days - your tour deposit (but see * below) 56 – 28 clear days - 50% of tour price 27 – 15 clear days - 70% of tour price 14 clear days or less - 100% of tour price * If all self-drive guide material has been provided in advance of the final balance having been paid, and that tour is subsequently cancelled by you, then the non-refundable deposit will increase to 50% of the full tour cost. 2. If we have to cancel your tour A full refund of all monies paid, including tour deposit, will be made by us if we have to cancel your tour at any time due to H.M. Government prohibiting travel to France and/or Belgium, or a significant service provider or providers, such as a Channel crossing provider (but only if booked by us as part of your self-drive tour package) or hotel(s) being unable to honour your self-drive tour booking for   the dates   of   your   travel . In these circumstances you have the option of a full refund, or at your discretion accepting alternative hotel arrangements of equal or similar standing, or the option of your tour being re-scheduled to a specified future date if this is feasible. * If a full refund is due in accordance with (2) above, after all self-drive guide documents having been provided, then the cost of the guide material provided will be deducted from the refund due. 3. Discretionary re-scheduling of a tour At   our   discretion , we may offer to re-schedule a self-drive tour as opposed to invoking option (1) above, notwithstanding that our above cancellation policy shall continue to apply to the tour date you originally booked. As a general rule, a re-scheduled tour should not change the number of persons comprising the original tour (substituting persons usually not a problem at no additional cost) or total nights away, and most importantly cannot again be re-scheduled. If a re-scheduled tour is subsequently cancelled, and all guide material has been provided, then such a cancellation will be subject to a minimum forfeiture of 50% of the total tour cost. 4. Addition costs which may apply to a re-schedules tour The non-refundable deposit requirement for a re-scheduled tour as outlined in our tour quotation document shall increase to from 25% to 35% of the tour cost as revised. Compliance with Covid-19 related conditions and requirements It shall remain the responsibility of each and every traveller comprising a self-drive tour group to ensure that he/she/they fully comply with all prevailing Covid-19 vaccination and documentary rules and requirements as may be imposed as a condition of travel with Le Shuttle (formerly known as Eurotunnel Le Shuttle) or P&O Ferries, as well as those rules and requirements as may be imposed by the governments of the UK, France and Belgium. Somme   Battlefield   Tours   Ltd   shall   not   be   liable   for   any   consequences,   pecuniary   or   otherwise, resulting    from    the    failure    of    any    person    comprising    the    tour    group    to    meet    the    vaccination    and/or documentary   requirements   for   travel   as   may   be   required   at   the   time   of   travel   by   Eurotunnel,   and/or   P&O Ferries, or as may be required by the governments of the UK, France and/or Belgium. Brexit We shall not be liable for any losses or additional expenses suffered by you, or any member of your group, as the result of any additional expenses, changes, disruption, or cancellations caused by or relating to both P&O Ferries and Eurotunnel arising from the United Kingdom leaving the European Union (aka ‘Brexit’). This provision shall also apply to changes to passport requirements, driving licences/permits and insurance Green Cards arising from the United Kingdom leaving the European Union (aka ‘Brexit’). ‘Force Majeure’ We accept full responsibility for ensuring that the services we contract to provide are to a reasonable standard, subject to the provisions of ‘force majeure’. This provision means that we will not be responsible for the consequences arising from war, riot, accident, pandemic/epidemic, civil strife, industrial dispute(s), crime, natural or nuclear disaster, disease, Acts of God, adverse weather conditions, or such similar occurrences. Travel Insurance Each and every person comprising a tour booking with us (including all those travelling with the person booking a tour) must   be   comprehensively   insured   (both   pre   and   post   ‘Brexit’)   for   both   medical   and   travel   to Belgium   and   France   as   a   condition   of   booking   a   tour   with   us.   This   same   condition   also   applies   to   breakdown cover   and   vehicle   repatriation (for clients travelling from the UK). See also ‘Driving in the UK, France and Belgium’ to the right here. Passports You must ensure that you and all members of your group are in possession of a valid passport and Visa (where applicable) for travel to France and Belgium (and UK for non-UK residents). We will not be liable for the consequences of any failure to comply with this important requirement, including any additional requirements arising from the United Kingdom leaving the European Union (aka ‘Brexit’). Eurotunnel (liability for excess charges) If you arrive within 2 hours of the booked departure time, the booking will be exchanged without charge . If you arrive more than 2 hours but no more than 24 hours after the booked departure time on your outward journey, the booking will be exchanged but you will be required to pay any difference between the price SBT paid and the price applicable to the departure for which your booking is exchanged . For bookings of 3 or 4 days’ duration : if you arrive more than 24 hours after the booked departure time on your return journey, your booking will not be exchanged . For bookings of 5 days or more duration : if you return after midnight on the day of booked departure time on your return journey, your booking will not be exchanged . Vehicles fitted with LPG LPG (Liquefied Petroleum Gas) and dual powered vehicles (i.e. vehicles fitted with an LPG tank as an alternative fuel) cannot be accepted for transport by Eurotunnel . Self-Drive Tour Costs We undertake to arrange your ferry/tunnel travel, and bed and breakfast hotel/guest house accommodation. We will also provide you with a comprehensive tour pack as described in the appropriate section of our website (www.battlefield-tours.com). The tour cost does not include lunch and evening meal as experience has shown that travellers usually wish to have freedom of choice regarding where and what to eat, as opposed to being tied to a hotel. The tour price does not include additional costs such as museum fees, travel insurance, car hire, cabin/room upgrades, newspapers, telephone calls, additional food and beverages, wine/beers/spirits etc. Driving in the UK, France and Belgium Somme Battlefield Tours Ltd shall not be liable or in any way responsible for any failure or alleged failure of any self-drive client(s) to fully comply with all road traffic and other associated requirements, laws, rules and regulations, including all licence, equipment, vehicle construction and use, insurance and documentation requirements, when driving in the United Kingdom, France and Belgium, including any additional requirements imposed (such as insurance ‘Green Cards’) as a result of the United Kingdom leaving the European Union (aka ‘Brexit’). Furthermore, will not be responsible or liable for any penalties, financial or otherwise, imposed by any governing or regulatory body, organisation or country for any failure to comply with any rules, regulations or laws that may be incurred whilst participating in a tour arranged or provided by us, including those arising from, or associated with, the United Kingdom leaving the European Union (aka ‘Brexit’). There are many helpful websites where advice can be obtained, such as those provided by motoring organisations such as the RAC and AA. Disruptive Behaviour Client(s) behaving in a disruptive manner may, after warning and/or at the discretion of us (or hoteliers in the case of self-drive tours), be required to leave the tour or hotel premises without recompense for termination of residence/booking/tour contract. Under such circumstances we shall not be liable for any additional costs (e.g. travel, accommodation etc), nor refund for termination of stay/residence/tour contract etc. Disability and other Special Requirements Having regard to the nature and size of our organisation, we are committed to taking all reasonable steps to accommodate persons experiencing most forms of disability. It is your responsibility to tell us in advance if you (or any of your group if appropriate) have any disability, dietary requirement, or other condition/special need.
